Registration

You can browse any of our Sites without being required to login. However, to participate in our rewards program, purchase a product, contribute content or participate in a discussion forum, you will need to create an account.

You must be 18 years of age or older to register an account with the Elporia Network.

If and when you decide to set up a new account, you agree to:

(a) provide true, accurate, current, and complete information about yourself as prompted by our registration form (including your e-mail address); and

(b) maintain and update your information (including your e-mail address) to keep it accurate, current, and complete.

In addition, you acknowledge and agree that should any information provided by you be found to be untrue, inaccurate, not current, or incomplete, we reserve the right to terminate any Agreement(s) with you and your current or future use of our Sites (or any portion thereof).

You will be required to create passwords and account designations upon completing certain Site registration processes and as a result, you are wholly responsible for maintaining the confidentiality thereof and wholly liable for all activities occurring thereunder.

Or to put it more plainly, you are solely responsible for all activity that occurs with your account, regardless of whether you have authorized such activities or not.

After your account has been established, you agree NOT to distribute, transfer or resell your use of, or access to, any of our Sites to any Third Party.

Each website that is affiliated with the Elporia Network handles user Registration Data in accordance with the Elporia Privacy Policy.

SocMe Login

Instead of being required to enter your credentials to create a new user account (though you can if you prefer), we are allowing our customers to use their social media (SocMe) logins:

– VK, and
– Yahoo

to access any of the Sites that belong to the Elporia Network.

When, for example, you wish to purchase a product or leave a comment, you will be required to sign in with the Site and at that time, you will be given the option to choose which login credential you prefer to use.

Please note:

The Elporia TOS do not apply to Third Party services used to create an account or log into one of our Sites.

Similarly, a TOS created by a Third Party service does not apply to the Elporia Network.

Termination

The follow provisions are the criteria we use to delete an account:

You agree that any termination of your access to one or more of our Sites under any provision of this TOS Policy may be effected without prior notice, and acknowledge and agree that Elporia or one of its Partners may deactivate your account without prior notice and/or delete any related information and files in your account.

You agree that the Elporia Network will not be liable to you or any Third Party for any termination of your access to one of our Sites.

You agree that a termination of your account or access to any component of one of our Sites will not invalidate Elporia’s rights to your User Content.

you agree that we have the right to bar any further access to such files or Site-in-question.

As well, if applicable, the Elporia Network, in its sole discretion, may suspend or terminate your account (or any part thereof) due to:

A lack of use; i.e., the account has been dormant for an extended period of time or the email address associated with the account is no longer valid.

Any suspected fraudulent, abusive or illegal activity may be grounds for termination and depending on the circumstances, the matter may be referred to the appropriate law enforcement authorities for further action.

Authorized Changes

The websites and services we provide may change due to: planned upgrades, new innovations, unforeseen events or circumstances beyond our control. Therefore, we may find it necessary to rewrite or modify some of the sections outlined in this TOS.

As a result, the Elporia Network reserves the right to modify or discontinue, temporarily or permanently, one or all of our Sites (or any part thereof) with or without notice.

You agree that the Elporia Network or one of its Partners will not be liable to you or to any third party for any modification, suspension or discontinuance of a product, service or application.

If changes to any of our policies directly impacts your use of our Site(s), we’ll post a notification and send emails alerting you to the proposed modifications, well in advance or before any changes are implemented – unless, of course, another type of notice is required by law.

If you don’t agree to the new TOS, you are required to delete your account before the end of the Notice Period.

If your account is not terminated before the end of the Notice Period, any saved content attached to the account and your use of one or all of our Sites will be subject to the new TOS from that time forward. And by continuing to use the Elporia Network, it is understood that you have consented to the revised TOS and any terms and conditions described in it.

Unauthorized Changes

The websites and services we provide may change, or be changed, as a result of unauthorized activities that will require remedial actions or a complete takedown of the content or the website.

You acknowledge that one or more of our Sites might include:

exaggerations, falsehoods, inaccuracies or errors.

materials that violate these TOS (specifically, as outlined in the “Code of Conduct” section).

We make no guarantees whatsoever as to any of our Sites’ veracity, truthfulness, completeness or correctness.

In the event that content being hosted on our site leaves you with the impression that something is amiss due to what appears to be: mischief, mischaracterization or misrepresentation, please contact us immediately, either by phone, email or using one of our secure online forms (contact forms can be found in the menu bar for each of our Sites) with, if possible, a description of the material(s) to be checked and the location (URL) where the questionable material(s) can be found, as well as any information we can use to follow up with you.

We will address your concerns and report back to you ASAP.

Code of Conduct

The Elporia Network provides venues for shopping, discussion and user participation. With that in mind, this Code of Conduct has been compiled in order to ensure that everyone who visits one of our websites is treated fairly, equally and with respect.

No User shall transmit Content or otherwise conduct or participate in any activities on our platform that, in the judgment of Elporia or one of its Partners, is likely to be prohibited by law in any applicable jurisdiction, including the solicitation of minors, the transmission of obscenity, or the permissible uses of Intellectual Property.

Each User, by using one of our Sites, may be exposed to content that is offensive, indecent or objectionable, based on community standards in their location but not considered offensive, indecent or objectionable in other municipalities, regions or countries. Please take that into consideration before registering an objection.

Each User has a responsibility to evaluate, and bear all risks associated with the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.

The Elporia Network reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from one of our Sites, suspending or terminating the account of such violators and reporting, if deemed necessary for our own protection, any alleged illegal behavior to the appropriate law enforcement officials (LEOs) and/or regulatory/governmental authority.

Please consult the following documents: Code of Conduct and Community Guidelines for a more detailed and nuanced explanation, together with examples, of what is, and isn’t, permitted, content- and behavior-wise on the Elporia Network.

Access LEO

Besides the risk of termination, if Elporia or one of its Partners suspects that a User’s Account has been used for an unauthorized, illegal, criminal or terrorist-related purposes, it will be reported to law enforcement officials (LEOs) and if required, the LEOs or their Agents will be given access:

The Elporia Network will only grant access to a User’s Account information upon the receipt of a validly issued subpoena, a National Security Letter (NSL), an administrative/investigative demand or warrant.

If such legal instruments are forthcoming, you hereby give the Elporia Network express authorization to share information about you, any Accounts you have, any information about content or data you have submitted or downloaded, and you also release us from any liability and permit us to openly and freely participate in any ongoing investigations.

Content Deletion

As a user of the Elporia Network, you are authorized to delete any of the content you submit, bearing in mind:

1) If your content forms part of a social construct that is interwoven with other users’ content and if it has been posted in a public forum, it may be impossible to delete your contribution without compromising the integrity of the overall thread or discussion. In cases like that, rather than deleting your information entirely, we will enable you to remove your name, handle (user name), and any other identifying information from the entries. In other words, the content will remain, but the attribution to you will not.

2) You should be aware that even if you delete something, it may not disappear immediately or completely due to caching and the use of backups to store multiple copies in the event of a system failure.

However be advised that once you hit delete, it’s game over. Your content becomes instantly unrecoverable, even by our system administrators.

3) The Elporia Network reserves the right to refuse or remove any content you post, submit, or transfer to one of our Sites, for any reason or even no reason. Please refer to our Code of Conduct to learn what kinds of content are acceptable.

Should we become aware of a violation, we may remove or deny access to your content, suspend or alter your user name, and in extreme cases, delete your account.

Sometimes new issues emerge that haven’t been addressed in the Code of Conduct so we reserve the right to block or delete content from the Elporia Network at our sole discretion, especially if we are receiving complaints from other users.

Given the type of content that is being posted on The Weakly Fap, don’t be surprised if it’s our own staff who are on the receiving end of a take down notice.

Offensive Content

Our statement regarding offensive content:

Elporia and our Partners accept no liability for content on the Elporia Network that you might consider to be offensive, indecent, or objectionable. Certain videos, movies, TV programs, video games, computer games, and other Products are labeled with age restrictions or are intended for “mature” or “Adult Only” audiences. By ordering an age restricted item, you certify that you satisfy the age restrictions.

For your protection, product listings for age-restricted products will be clearly labeled unless you happen to be looking at, listening to, or viewing Adult Only content.

The same procedure applies to the acquisition of products and services that are meant for adults, and not children or minors.

Content Retention

The following procedures outline the practices used by Elporia and its Partners concerning content retention:

To help ensure community access to Content that has been posted to one of our sites, when users first post Content on one of our Sites but later decide to announce or release future Content through another external site say, for example on a news aggregation site or discussion forum, Elporia and our Partners have the right (but not the obligation) to archive the original Content and rewrite or make a new copy of the Content curated by one of our websites. The set of Content included in this updated or curated copy is within the sole discretion of the elporia Network or one of its partners, and may include references to, updates, or a subset and/or a superset of the Content posted by the user to the external website.

The Elporia Network does not control the content posted to external Sites and, as such, do not guarantee the accuracy, integrity or quality of such content.

Submissions (by Users)

The following procedures outline the terms and conditions that pertain to content that is uploaded to our websites.

By submitting user content to the Elporia Network, you grant us an unlimited license to use your content in any way we choose.

This includes creative uses such as republishing the work on one of our Sites, and elsewhere, and practical uses such as copying your content to make back ups, displaying your content on one of our Sites, and distributing and modifying your content, as needed, to make our platform work properly.

Furthermore, when you submit content for use on the Elporia Network, unless stipulated otherwise, you are agreeing that your content will be made available under the same terms and conditions as content published on the rest of our Sites, viz., a Creative Commons License permitting non-commercial sharing with attribution.

Because our servers are located remotely, and because user data is retained indefinitely, you also grant us these rights worldwide and irrevocably, and agree that we don’t owe you royalties for any use of your content based on these rights.

The Elporia Network accepts no responsibility, nor assumes liability for, and expressly does not endorse or share the opinion of any content you submit for consideration on our Sites.

Under no circumstances will Elporia be liable in any way for any content, including, but not limited to, liability for any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed or otherwise transmitted via the Sites.

All information, data, ideas, text, music, sound, photographs, graphics, video, notes, messages, concepts, trademarks, service marks, or any other materials whatsoever (collectively, “content”), whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such content originated.

When you upload material to the Elporia Network, you represent and warrant that:

1) You own or have sufficient rights to post or make available your submission on one of our Sites;

2) You have fully complied with any Third Party licenses, if applicable, and agree to pay for all royalties, fees and any other monies owing to any person or entity due to the fact that you posted content without obtaining their express written permission;

3) Your submission does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights, including Intellectual Property rights, of any person or entity;

4) Your submission is not considered: obscene, lewd, lascivious, excessively violent, harassing, libelous or slanderous;

5) Your submission does not contain material that solicits Personal Information from anyone under the age of 18 or exploit people under the age of 18 in a sexual or violent manner, and does not violate any federal or state law concerning child pornography or otherwise intended to protect the health and well-being of minors;

6) Your submission does not discriminate, incite harassment, or advocate harassment of any group or individual;

7) Your submission does not incite, encourage or threaten immediate physical harm against another person or entity;

8) Your submission does not endorse or promote racism, bigotry, hatred, or physical harm of any kind against another group or individual;

9) Your submission does not advocate the violent overthrow of the government of the United States, Canada or a member of the European Union or another legally recognized region or country; and

10) Your submission does not contain any viruses, worms, Trojan horses, Easter Eggs, time bombs, spyware or other harmful or destructive malware.

11) Your submission does not contain any computer code, file, program that is or is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software, or equipment owned and operated by the Elporia Network

Elporia, in its sole and absolute discretion, may preserve Content and may also disclose Content if required to do so by law or judicial or governmental mandate or as reasonably determined useful by Elporia and Partners, to protect the rights, property, or personal safety of the Sites’ users and the public.

By sending or transmitting to us content, or by posting such material to any area of our webites, you grant us and our Partners and/or designees a worldwide, non-exclusive, sub-licensable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to link to, reproduce, distribute (through multiple tiers), adapt, create derivative works of, publicly perform, publicly display, digitally perform or otherwise use such content in any media now known or hereafter developed.

In addition, and if applicable, you hereby grant the Elporia Network permission to display your logo, trademarks and company name on the Sites, product and website reviews, and in press and other public releases or filings.

to reiterate, by submitting Content to one of our websites or brands, you agree and acknowledge that you have the authority to grant such rights to the Elporia Network.

Finally, you should be aware that

YOU – and “not” elporia or its partners or its affiliates – RETAIN OWNERSHIP OF ANY COPYRIGHTS, TRADEMARKS AND SERVICE MARKS IN ANY CONTENT YOU SUBMIT TO ONE OF OUR WEBSITES.

Children

The Elporia Network does not knowingly collect Personal Information from under-aged individuals.

Due to the fact that the Elporia Network sells products and services designed for and marketed to Adults, you must be 18 years or older to register with one of our websites.

To be clear, while some of our Sites might be suitable for minors, other Sites like Fapware.com and Metabong.com are not. Therefore, in an effort to err on the side of caution, we are going with a one-size-fits-all solution.

No one under the age of 18 may create an account on any of our Sites that requires the submission of Personally Identifiable Information (PII).

If we discover that an account has been created by a person under 18, it will be terminated immediately and any data created in conjunction with that account will be deleted.

If you have reason to believe that a minor has provided PII to the Elporia Network please contact us ASAP and we will take the necessary steps to eradicate any information provided by a minor from our databases.

Disputes

The following provision outlines our hands-off approach concerning user disputes:

You agree that you are solely responsible for your interactions with other users in connection with your use of the Elporia Network. Elporia, together with one or all of its Partners, has no liability or responsibility with respect to any disagreements.

Elporia reserves the right, but has no obligation, to become involved in dispute resolution between you and our Partners or any other Third Parties who may be using one of our Sites.

International Users

If you are visiting or using the Elporia Network from outside the United States, you understand and acknowledge that:

your Personal Information will be transferred from your location to our facilities and servers which are domiciled in Atlanta, Georgia, USA.

your Personal Information may be cached on a server located outside the United States, say in Canada or Greece.

(a) goods licensed or sold on the Elporia Network, and (b) any software or technology purchased, downloaded, or used from one of our Sites, are subject to the customs and export control laws and regulations of the United States of America and may also be subject to the customs and export laws and regulations of the country in which the products are manufactured and/or received, and you agree to comply with all applicable laws.

For users of the Elporia Network, you represent that you are NOT a person on a list barring you from receiving services under U.S. laws or other applicable jurisdictions, including without limitations, the Denied Persons List and the Entity List, and other lists issued by the U.S. Department of Commerce, Bureau of Industry and Security.

Users residing in countries on the United States Office of Foreign Assets Control sanction list, including Cuba, Iran, North Korea, Sudan and Syria, may not post content to, or access content available through one of our online stores or Sites.

In addition, please be advised that if you or a proxy places an order with one of our Sites, we will not ship to these destinations.

Ideas & Suggestions

The Elporia Network and its Partners provides functionality (e.g. online forms) that enables users to make available insights, feedback and recommendations in connection with our online stores, subject to the following restrictions.

We prefer text written in English but we accept: French, Spanish and Greek. Any other language will be submitted to a translation service which may or may not distort the original meaning intended by the author. Though, if that appears to be a problem, we’ll contact the author to make sure there is no misinterpretation.

You acknowledge and agree that you are responsible for any and all submissions you make available in connection with any Elporia Network and its Partners Site.

You represent and warrant that:

you have the authority to grant the rights to any ideas or suggestions put forward in conjunction with, and as set forth in, our Terms of Use; and

any ideas and/or suggestions so proffered, does not, and will not, violate our Terms of Use.

This means you will be responsible for the legality, the accuracy, the appropriateness, the originality, and the rights to any such input you are tendering for consideration.

Any ideas or suggestions you submit must comport and comply with our TOS sub-section on User Submissions.

You further agree that the Elporia Network and its Partners are free to use any ideas and suggestions for any purpose.

You grant to the Elporia Network and its Partners the right to use any name(s) associated with any Ideas and Suggestions that you make available to the Elporia Network and its Partners, although the Elporia Network and its Partners are under no no obligation to exercise such right, or to otherwise provide any attribution for any Ideas and/or Suggestions.

you have the authority to grant the rights to any ideas or suggestions put forward in conjunction with, and as set forth in, our Terms of Use; and

Be advised that the Elporia Network and its Partners may sub-license its rights in any ideas and/or suggestions through multiple tiers of sub-licenses.

Elporia Network and its Partners are, and will be, under no obligation:

(1) to maintain any Ideas and/or Suggestions in confidence;

(2) to pay any compensation for any Ideas and/or Suggestions, unless we decide otherwise; and

(3) to respond to any Ideas and/or Suggestions, though if we can, we will, out of respect for, and as a courtesy to, the person taking the initiative to contact us in the first place.
